Creatoon Studio — AI Video Generator for Viral Shorts

1. ACCEPTANCE OF TERMS

By accessing or using Creatoon Studio ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Age Requirements:

You must be 18 years or older to use Creatoon Studio
If you are between 13-18, you may only use Creatoon Studio with parental consent

2. AI-GENERATED CONTENT DISCLAIMER

Creatoon Studio uses AI models to generate videos and images. You acknowledge that:

2.1. Probabilistic Nature: AI models are probabilistic and may produce inaccurate, repetitive, or offensive content. We do not guarantee the uniqueness or factual accuracy of generated assets.

2.2. No Professional Advice: The Service is for entertainment and creative purposes only. It should not be relied upon for legal, medical, or financial advice.

2.3. Third-Party Resemblance: AI outputs may unintentionally resemble existing works or real persons. You are responsible for ensuring your use does not infringe third-party rights.

3. INTELLECTUAL PROPERTY RIGHTS

3.1. Your Inputs: You retain ownership of the text prompts and images you upload to the Service.

3.2. Your Outputs: Subject to your compliance with these Terms and full payment of applicable fees, we assign to you all commercial rights, title, and interest in the specific videos and images generated by you using the Service.

3.3. Platform Use: You grant us a perpetual, non-exclusive, royalty-free license to use your Inputs and Outputs to operate the Service, improve our AI models, and for marketing purposes (e.g., a "Showcase" gallery), unless you opt-out via account settings.

4. USER REPRESENTATIONS & PROHIBITED CONTENT

You agree not to use the Service to generate:

4.1. NSFW/Adult Content: Nudity, pornography, or sexually explicit material.

4.2. Deepfakes/Impersonation: Content that mimics real persons (especially public figures) without their consent, or is intended to deceive/mislead.

4.3. Hate Speech: Content promoting violence, discrimination, or harassment.

4.4. Illegal Content: Any content that violates applicable laws.

Violation of this clause will result in immediate account termination without refund.

5. CREDIT PACKS & PAYMENTS

5.1. Credit System: Creatoon Studio operates on a credit-based system. Credits are consumed when generating content.

5.2. Genesis Credit Packs

The following credit packs are currently available:

Starter Pack: 750 credits for $10 USD
Pro Pack: 2,100 credits for $50 USD
Ultra Pack: 4,500 credits for $100 USD

Note: These "Genesis Credit Packs" are the current offerings. Pricing and structure may change. The Referral Program (Section 6) applies exclusively to these specific Genesis Credit Packs.

5.3. Credit Expiration: Credits do not expire. Once purchased, credits remain in your account until used.

5.4. Payment Processing: Payments are processed securely via Stripe. All transactions are encrypted and handled according to PCI-DSS standards.

5.5. Refund Policy: Due to the nature of digital goods and GPU processing costs, we generally do not offer refunds. Exceptions may be considered at our sole discretion for technical issues.

6. REFERRAL PROGRAM

6.1. Commission Structure: Creatoon Studio offers a referral program with the following commissions:

50% commission on referred user's first purchase
20% commission on all subsequent purchases by that user

⚠️ Scope Limitation

6.2. Applicable Products: Referral commissions apply EXCLUSIVELY to purchases of the "Genesis Credit Packs" as defined in Section 5.2. If Creatoon Studio introduces new credit packs, subscription models, or other products in the future, the referral program terms will NOT automatically apply to those new offerings unless explicitly stated in updated terms.

6.3. Payout Terms: Commissions are tracked in your account. Payouts are subject to a minimum holding period of 30 days from the date the commission is earned. This holding period may be extended up to 90 days (3 months) if additional verification is required or if the referred user's payment is disputed, refunded, or reversed.

🚫 Commission Clawback & Fraud Prevention

6.4. Commission Clawback: We reserve the right to withhold or claw back commissions if the referrer or referred user violates these Terms of Service, engages in fraudulent activity, or if the referred user's payment is refunded, disputed, or reversed.

6.5. Fraud Detection: We actively monitor for suspicious referral patterns including but not limited to: bulk signups, bot activity, self-referrals, fake accounts, and coordinated abuse. We reserve the right to audit referral claims, suspend payouts pending investigation, and permanently ban accounts engaged in fraudulent activity.

6.6. Minimum Payout Threshold: Commissions must meet the minimum payout threshold of $100 USD before a payout can be requested.

6.7. Program Changes: We reserve the right to modify commission rates, payout thresholds, holding periods, or discontinue the referral program at any time with reasonable notice.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Creatoon Studio shall not be liable for any indirect, consequential, or incidental damages. Our total liability to you shall not exceed the amount you paid us in the 6 months preceding the event giving rise to the claim.

8. TERMINATION

8.1. Our Rights: We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or at our sole discretion.

8.2. Effect: Upon termination, you lose access to your account and any unused credits. We have no obligation to refund unused credits upon termination for cause.

9. GOVERNING LAW

These Terms are governed by the laws of Romania and the European Union. Any disputes shall be resolved in the competent courts of Bucharest, Romania.

10. CHANGES TO TERMS

We may update these Terms at any time. Material changes will be communicated via email or website notice. Continued use of Creatoon Studio after changes constitutes acceptance of the updated Terms.
